By accessing or using Cortex ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

Important: These terms apply to all users of Cortex, including free and premium subscribers.

Cortex: Cortex is an AI-native productivity platform that combines tasks, calendar, journal, and AI assistant in one unified ecosystem. The platform gamifies productivity through XP systems, AI personalization, and social features.

Service Availability: Cortex is available as a web application at app.cortexxp.com and as a desktop application for Windows and macOS.

Pricing Tiers: Cortex offers Free, Pro ($9.99/month), and Premium ($18.99/month) tiers with different feature sets and AI request limits.

Account Creation: To use Cortex, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials.

Data Privacy: Your personal data and productivity information are protected according to our Privacy Policy. We do not sell or share your personal data with third parties.

Secure Storage: Your data is stored securely and encrypted for your protection. We use industry-standard security measures to protect your information.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or servers
• Share your account credentials with others
• Use the Service to harm, harass, or intimidate others
• Reverse engineer or attempt to extract source code
• Spam or abuse our communication systems
• Violate any applicable laws or regulations

Ownership: The Service and its original content, features, and functionality are owned by Ilias Mahboub and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

License: The Service is provided for your personal, non-commercial use only. You may not copy, modify, distribute, sell, or lease any part of the Service.

Open Source: Some components may be open source and subject to their respective licenses.

No Liability: In no event shall Cortex, its founder, or contributors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Maximum Liability: Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid for the Service (if any).

AS IS: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Cortex makes no warranties, expressed or implied, and hereby disclaims all warranties, including without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement.

Pre-Launch Software: As Cortex is still in development, we cannot guarantee specific launch dates or that all planned features will be available immediately upon launch.

Account Termination: We may suspend or terminate your account if you violate these terms, engage in harmful behavior, or fail to pay subscription fees.

Effect of Termination: Upon termination, you will lose access to your account and data. You may export your data before termination.

Cancellation: You may cancel your subscription at any time through your account settings or by contacting support.

Modifications: We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

Continued Use: Your continued use of the Service after any changes constitutes acceptance of the updated terms.

Third-Party Components: Cortex may include open source software components. These components are subject to their respective open source licenses, which are separate from these Terms.

License Compliance: You acknowledge that your use of such components is governed by their respective licenses, and you agree to comply with those licenses.

Jurisdiction: These Terms shall be interpreted and governed by the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.

Enforcement: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

International Use: The Service is available globally. Users are responsible for ensuring their use complies with local laws and regulations in their jurisdiction.

Minimum Age: You must be at least 13 years old to use the Service. If you are under 18, you represent that you have parental or guardian consent to use the Service.

COPPA Compliance: We do not knowingly collect personal information from children under 13. If you are a parent and believe your child has provided us with personal information, please contact us immediately.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Force Majeure: We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, fire, natural disasters, power outages, or government actions.

Service Availability: We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be unavailable due to maintenance, updates, or unforeseen circumstances.

Beta Features: Some features may be marked as beta or experimental. These features may have limitations or be subject to change.

Data Backup: While we implement backup systems, you are responsible for maintaining backups of your important data.
